Locke Lord’s leadership role in lending and finance transactions runs the gamut from involvement with small business loans to complex billion-dollar syndicated credit facilities. We have the practical background to spot issues and problems that may arise in such transactions and the legal skill to handle them with effective, innovative solutions.
Our attorneys have a great deal of experience in every facet of secured and unsecured credit facilities, and our knowledge of securing collateral extends to nearly every kind of property, from raw land to intellectual assets. We assist with subordination agreements, securitizations, intercreditor agreements, interest rate options, collateral trust and custody agreements, limited recourse provisions and all other issues relating to credit facilities.
If a financed transaction subsequently runs into difficulties, we evaluate the implications of a loan workout or refinancing and help implement an appropriate strategy to deal with the troubled financing. Our attorneys handle all legal aspects of large auctions of foreclosed real estate and loan assets and have provided the legal work in connection with multi-billion dollar mass loan portfolio acquisitions.

We have helped lenders take as security collateral of virtually every type, common and uncommon, including broadcasting licenses, bank stock, intellectual property rights, securities, livestock, railroad lines and equipment, rolling stock, pipelines, offshore leases, aircraft and drilling rigs.
We have wide-ranging insight into arrangements among creditors, especially syndication, market expectations, loan securitizations of all types, participations, subordinations, sales and purchases of loans and loan servicing rights, intercreditor agreements, collateral sharing and stand-by letters of credit. We assist financial institutions and others in various derivative transactions, particularly interest rate swaps and related instruments. Our attorneys are involved in public finance matters and represent issuers and financial services companies in all aspects of that market.
